Justice For 4 Nigerian Fishermen: No Hiding Place For Shell, ERA/FoEN Emphasizes

By Simeon OSAJIE

The Environmental Rights Action/Friends of the Earth Nigeria (ERA/FoEN)
has welcomes the recent judgement by the Netherlands Court of Appeal that held Shell liable for the oil spills it caused across Nigeria’s coastal communities of the Niger-Delta in 2008.

Recall that in 2008, four (4) Nigerian farmers from Ikot Ada Udo, Oruma and Goi in the Niger-Delta supported by the Environmental Rights Action/Friends of the Earth Nigeria (ERA/FoEN and sister organization, Milieudefensie/Friends of the Earth Netherlands, sued Shell because of oil pollution in the three Nigerian villages.

This case was the first in which a Dutch company, together with its subsidiary, had been sued in a Dutch Court for damage caused abroad.

Shell in the process argued that the actions committed in Nigeria cannot be tried in the Netherlands. It also denied it caused the spill and that criminals and third party interference were responsible for oil spills in 2008.

On their part, the farmers demanded that Shell clean up the oil spills; pay compensation for the damages caused; and improve the maintenance of its pipelines and installations to prevent future spills.

The court had ruled in December 2015 that Shell must provide the plaintiffs internal company documents essential to the case and this was the first of its kind in the Dutch legal history.

In a press statement issue and signed by Barr Nosa Tokunbor, Legal Officer, Environmental Rights Action/Friends of the Earth Nigeria stated that the case had dragged on for over 13 years with a lot of legal somersaults occasioned by Shell, noting the Appeal Court in the Hague on January 29, 2021 ruled that Royal Dutch Shell was liable to pay compensation for the oil spills which polluted rivers, fishpond and farmlands that thousands of local farmers and fishermen.

But reacting to the court ruling, Dr. Godwin Uyi Ojo, Executive Director, Environmental Rights Action/Friends of the Earth Nigeria (ERA/FoEN), described the outcome of the case as a landmark judgment which the organisation is very proud of.

He said the judgement showed that the days of oil companies in Nigeria, particularly Shell criminalizing local communities and framing them up for sabotage of crude oil pipelines are over. According to him, “Shell no longer has any hiding place, as this victory will open up a floodgate of court cases against Shell and the oil companies doing business in Nigeria and hiding under weak regulations, lack of enforcement of its extant rules, and taking advantage of the lack of political will of the Nigerian government to bring oil transnationals to account.

“The significance of the landmark judgement is that it addresses the question of access to justice that is very much in question in Nigeria when it comes to holding the oil companies accountable for their human rights violations and environmental degradation. The judgment has further shown the environmental liability of parent companies for the conduct of their foreign subsidiaries,” Ojo stated.

Dr. Ojo further stated that “the judgement is urgent and strategic as the world transits away from fossil fuels there is the need to ensure that the devastation done to our environment by Shell is cleaned up and appropriate compensation is paid to communities that have suffered in many cases irreparable losses.

"Notably, Shell has been selling its land based assets and along with it, its legacies of environmental devastation, social dislocation, violence and poverty to avoid accountability. Therefore, “Our communities owe it to themselves and their generations unborn to ensure that Shell does not escape its responsibilities”.

He called on the Niger-Delta communities and CSOs not to relent in their pursuit for justice, adding that   over 13 years struggle in the court has paid off.

Dr. Uyi Ojo furtherp enjoined Shell to comply with the court proceedings while urging the judge to do the needful in awarding compensation and preventive costs.

ERA/FoEN again calls on the Nigerian government to revamp its regulatory bodies in the oil industry, ensure that criminal acts of oil transnationals are punished severely and that the country starts taking concrete steps to wean Nigeria of its dependence on revenues from oil and gas, build a new economy on the back of a clear renewable energy framework as quickly as possible and ensure the gradual phasing out of oil and gas activities in Nigeria.

Buhari Reflection In The Mirror 'Lauretta Onochie'' - Ugbo

By Simeon OSAJIE

Benin Solidarity Movement (BSM) worldwide is concerned with the attitude of President Muhammadu Buhari's aides who always sees nothing wrong in exacerbating already tense situations

In a press statement issued and signed by Elder Curtis Eghosa Ugbo
President, Benin Solidarity Movement (BSM) worldwide said, "Lauretta Onochie, the Senior Special Assistant on Social Media to President Muhammadu Buhari, who is well known for parroting anything no matter how senseless that she feels would place her principal in an advantageous position.

"Her mannerism is a direct reflection of what is the hallmark of all sides of Bihari who of recent has let the world know that he is more of a president of Fulani people contrary to what we have always thought is the case.

"It seems it is a taboo for his aides to disagree with the 'Fulani President' and step out of his team with their personality intact. Cases abound where such unrepentant 'yes men' end up being disgraced when they fall out of line with Buhari.

Going further, Elder Ugbo's statement added, "Over the years there have been cases of the heinous crimes committed by the untouchable Fulani herdsmen been reported with no single aide of Buhari condemning their action.

"So, it became a matter of world acclaim that the moment a people, who have suffered untold molestation and deprivation from the Fulani herdsmen, decided to rise and defend themselves their President, Muhammadu Buhari and his hirelings under 24 hours found their voice and make a case in defence of the criminal elements.

"BSM wish to remind Lauretta and her co-travellers in the Buhari government that history abound of so called untouchables of yester years spending their last days in the gulag.

"From all indications it is a foregone conclusion that similar fate awaits Buhari and others in Nigeria who turn a blind eye to injustice. Justice will be served to them in good dosage when the Lord's appointed time comes.

"A word is enough for wise!" the statement concluded.

"In fulfilment of her passionate desire for the Edo child and the elderly, we have decided to fast track the flag off of the programme to celebrate her birthday.

"What she stands for and believes in is assisting the downtrodden irrespective of their tribes or positions, should suffer.
"So, what you are seeing today, is her pet project, we call it Eunice Gordon-Osagiede School Shuttle (EGOSS). Is free  bus, free ride for all students, primary and secondary and the only condition is that, you be on uniform and as soon as you ate plying and your school falls within the route, we will take you there free of charge.

"Bishop Gordon Osagiede decided to add to it, the elderlies. We feel that they should be supported, this is our own token in supporting them in getting to anywhere they want to go.

"The initiator proposed 20 buses but for now, we have 10 buses. The 10 buses  are going to be plying five routes in Benin metropolis  as from on the 2nd February, 2021 when the school will resume. The routes are Sapele Road, Upper Sokponba, Ikpoba Hill, Ugbowo and Ekewan road for a start and we will send about two buses for each route. It is free.

Earlier in his speech, Edo state governor, Mr. Godwin Obaseki who was represented by Secretary to the State Government, Osarodion Ogie Esq., hailed the late Apostle Osagiede for achieving the noble feat even in death, noting that it will help in solving the transportation problems faced by students in the state.

The governor noted that the free bus ride from a church is the first of its kind in the state, adding: “This is a very important decision of the Church as the move will help the state government in solving the transportation problems faced by school pupils and students.”

In his welcome address, Son of the late Apostle and Bishop of the Church, Gordon Ada-Gordon Osagiede (Jr.) commended Governor Obaseki and his wife for their encouragement and support.

Speaking earlier at the ceremony, Chairman, Pentecostal Fellowship of Nigeria (PFN), Edo State Chapter, Pastor Margret Agbonifo, said: “We return all the glory to God for mama's life, which was well spent as no moment of her life was wasted.

"PFN in the State is solidly behind the family and Church as Apostle Eunice Gordon Osagiede believed in the unity of the body of Christ. We equally thank the governor for standing with the family and the Church at these trying times of the late Apostle’s demise,” she said.

Be The First To Come Whenever Man of God Calls For Prayer – Pastor Ken Osazuwa Admonishes CDM Members

By Simeon OSAJIE

.            Pastor Ken Nosa Osazuwa
Founder/General Overseer of High   Refuge  International Ministry, Germany

The Founder/General Overseer of High Refuge  International Ministry, Germany, Pastor Ken Nosa Osazuwa has called on Christians faithful to always obey the voice of God whenever your pastor called for prayers. This he said is the only ways God can speedily answer your request.

He gave the encouragement on 24th January 2021 at the Sunday service of Chapel of Deliverance International Ministry Incorporated Headquarters at Uteh, Upper Mission Extension, Ikpoba Hill, Benin City, Edo State.
.             Apostle Mike Agbonkhese
       G.O. Chapel of Deliverance with
           Pastor Ken Nosa Osazuwa

The Pastor who was visiting the Ministry for the first time appreciated Apostle Mike Agbonkhese for the lives of two of his members who are based in Germany and are members of his ministry or over ten years.

Pastor Osazuwa said, “Apostle I want to say a big thank you, you are really Apostle indeed. I have two of your sons with me in Germany and we have been together for many years. Brother Godspower Best-Imadojemu and Evangelist Teba, Gift Best-Imadojemu are wonderful product of Chapel of Deliverance Ministry. I must confessed, they are such a wonderful people," he emphasized.

In his homily titled “The Prayer of Daniel”,  Pastor Osazuwa admonished the congregation to always emulate Daniel in the Bible. “When Daniel discovered that the government has signed a decree because of him, he went to his house, locked the door, go on his kneel and began to pray, he made supplication to God Almighty.  "God look at the decision and the plans they has against me."

"Children of God,  we must emulate Daniel when it come to prayer, it is our weapon to achieved whatever we wants from God.

Going further, Pastor Ken said, "When I was planning to travel to Europe, I never have money but I took the decision that the situation of my family must change, and if something have to change in my family, it must be through me, then l embark on fasting and prayer.
"I have lived in a country (Europe) where you cannot bribe or manoeuvre things, there is one thing you should note; it is only prayers that can manoeuvre things for your sake. I know this things for sure, I am not just saying it, I have tried it and it worked for me. Remember, God told us in the Bible, “If my people who called by My name, humble themselves and pray, turn away from their wicked way, I will healed their land.

"Europe is not like Africa where you can use connection to get whatever you want, it is only prayers that can do wonders in your life. Over their in Europe, you have no father, no mother, no brother, no sister, it is only prayers that can change your situation.
"So, I encourage you this day to change our mind set, be desperate in prayer. go on your kneel, cry and pray to God, He will not forsake you."

He therefore admonished  the congregants that anybody that need miracle in life must go into prayer travail

"This simply means, when a woman is going into labour, she does not care of everyone around her, the only assistance she received from people at that point in time is push, push push, she does not look at anyone that is laughing at her, she does not care about the doctor around her, she open everything for whoever is with her, in some cases, the nurses will be laughing, but what she need at that moment, is safe delivery.
"Immediately the baby comes out, she realized and quickly cover herself, those who were laughing at her will still joined her to celebrate.  If you can do that in the church when it come to prayer, I tell you, your miracle will be the order of the day.

"I come to challenge you today, the only help you need in the church is that someone who will encouraged you and say let go and pray.
"I therefore encourage you brethren that, those who laugh at you in your time of prayers, will join you to celebrate and they will be the one to say to you 'Congratulations.'

"Prayers is the only prolific missiles that can place the enemies out from you.  It is time to go to your makers," he opined.

Save Me From HRH Izevbokun, Osakpomwan Eriyo, Solomon Idahosa Appeals to Oba Ewuare II, Gov. Obaseki

By Simeon OSAJIE

Solomon Idahosa, an octogenarian has  appealed to the Oba of Benin, Ewuare II and Mr. Godwin Obaseki, the executive governor  of  Edo State to wade in and prevent His Royal Highness, Edwin Aigbe Izevboku, Enogie of Evboivbioba Village in Oredo local government area of the state and Osakpamwan Eriyo, aka "No Molest" from taking over his land.

In a petition to Oba Ewuare II  through his counsel, Imuentinyanosa Atoe  said that the Oba of Benin, Erediauwa of blessed memory gave verdict in favour of his client (Pa Idahosa) as the bonafide owner of the land in question in 2010.

He further stated that HRH. Izevbokun and his family were directed to stay off  the said land for him having earlier purchased the land through them.

"The failure of Enogie  to respect the verdict and comply with  the royal father, led to his suspension as  Enogie of  the community."

He added, "the duo's act is a pure violation of the Benin Monarch's and the Edo State government directive on the ban of the Community Development Association (CDA) because the said parcel of land was earlier sold to me  by the same traditional ruler in 2005.

"With the help of Osakpomwan Eriyo, HRH. Edwin Aigbe Izevboku has invaded my said farmland with armed men, chased away my labourers and destroy some portions of my economic crops with earth moving equipments with the so intent of repossessing it and they are yet to vacate the place.

"Similarly, our client took the  matter before the court in  Suit No. B/630/2010 against the Enogie claiming in 2010 when the Enogie  failed to stop the act of trespass to our client's land.

"That in the year 2013, judgment was delivered in the said suit in favour of our client after a term of settlement was entered into between both parties.

"That consequent upon the term of settlement by our client and the said Enogie, our client presented himself before the Omo N' Oba, N' Edo, Uku Akpolokpolo, Oba of Benin and pleaded passionately for the suspension placed on the Enogie to be lifted  which request made humbly was granted and the suspension was lifted."

The petitioner further explained that surprisingly, the Enogie and his family instituted a suit No. B/676/2020 for themselves and on behalf of Evboivioba community against our client claiming the said land over which the Oba of Benin and the Edo High Court have given verdict on the 26th day of November, 2013.

The petitioner lamented that despite the new suit filed, the Enogie and the family which is pending in the court of law, they took the laws into their hands by deploying bulldozers to the land and destroyed the palm trees planted on it.

However, the said persons alleged in the repossession of the land refused to pick up their phones despite series of calls put across to them.

Confirming the situation, the Police Public Relations Officer, Zone 5, ASP, Tijani Momoh said investigation into the said allegation has commenced and findings would be made public at the appropriate time.
